With all the best intentions in the world, it is inevitable that any Business with employees will need to refer to their Disciplinary or Grievance procedures at some point. Since Employment Tribunal fees were abolished in 2017 there has been a steady increase in claims being made. The types of claims that have increased the most include:
• Unfair dismissal
• Sex discrimination
• Disability discrimination
Below we have provided 2 scenarios that Businesses could make, which may lead to having to defend a claim:

Even if you caught them red-handed stealing from you, you must follow your Disciplinary Procedure. There are no exceptions.
We all know that person or employee that has a negative attitude and complains about everything. If it is something: They repeat, is of a serious nature or If they put it in writing, you need to take action.
You can try and resolve the issue informally to start with, but you cannot ignore it.
It could be an employee has a problem with you or a colleague? Their performance is extremely unsatisfactory? Or their behaviour is unprofessional? To name but a few…….
If you have an issue raised to you or are considering dismissing an employee, or need help or advice with performance management, contact us to make sure you won’t find yourself on the wrong side of the law!
